Oksana Yelenych – Senior Partner of the Labor and Employment Practice, Attorney of the Litigation and Dispute Resolution Practice, and Attorney of the War Damage Compensation Practice at ARMADA Law Firm, with over twenty years of legal experience, including 12 years in legal practice.

Oksana specializes in resolving complex commercial disputes, disputes with regulatory authorities, and has extensive experience representing clients in court, providing subscription-based legal support, and offering both oral and written legal consultations.

Before joining ARMADA Law Firm, Oksana gained her legal experience in government institutions. From 2002 to 2010, she worked in the State Tax Service, including 4 years as Head of the Legal Department, managing a team of 5 lawyers and attorneys, as well as in private businesses as a corporate lawyer. This enabled her to gain exceptionally valuable and diverse experience, which she now successfully applies in assisting the firm’s clients.

Oksana graduated with honors from the I.I. Mechnikov Odesa National University and holds a specialist degree in Law.

Recent Experience of Oksana Includes:

  • Successful support of court cases on compensation claims for property damage caused by the armed aggression of the Russian Federation, with a total amount exceeding 150,000,000 UAH.
  • Preparation of a detailed legal opinion at the request of a corporate client to provide additional support to its employees participating in combat missions to defend the homeland. The consultation covered the grounds and procedure for obtaining the status of a combatant, as well as the benefits, guarantees, and payments available to persons granted such status.
  • Support in a court case for a client who is the director of a major manufacturing company. The issue was that since 2022, the director wished to resign, but due to the loss of any contact with the shareholder, the general meeting could not be held, and no decision could be made regarding his dismissal according to the company’s charter. Oksana properly substantiated the legitimacy of the client’s claim in the first-instance court to recognize the termination of employment and to oblige certain actions. As a result of her comprehensive efforts, the court fully granted the claim – recognizing the termination of the employment relationship and ordering the registration authority to amend the company registry.
  • Support in a complex case where, following a State Labor Service inspection, a report was issued against a legal entity for employing individuals without formal labor contracts. Oksana successfully handled the court case challenging the inspector’s report, proving the absence of violations on the client’s part and thereby preventing a fine for “undeclared” workers.
  • Legal defense in a court case on administrative liability for the director of a manufacturing company. The case stemmed from a labor inspection report claiming unauthorized employment. A protocol on administrative offense was drawn up, which could have led to a fine. Due to Oksana’s prompt actions, the proceedings were closed due to the absence of an administrative offense.
  • Preparation of a detailed legal opinion for a client upon request regarding labor relations regulation, particularly on lawful ways to use employees’ labor beyond the normal working week and exceeding the overtime limits, as well as on developing a legally safe mechanism allowing changes to employee work schedules without prior two-month notice.
  • Court support in a case of a company leasing property, against the Russian Federation, seeking compensation for property damage in the amount of 476,000 USD. Within the scope of legal assistance, Oksana gathered evidence to confirm the damages, analyzed and systematized public information, state authority data, and the chronology of hostilities, along with other evidence, which enabled her to prove in court that the Russian Federation caused damage to the client. As a result, the court ruled in favor of the client, awarding 476,000 USD in compensation.
  • Support of a court case in the first and appellate instance for a large manufacturing company. Oksana proved the illegality of the tax notices-decisions. Primary documents examined during the audit confirmed the export of goods to counterparties, and the courts determined that there were no grounds for reducing the negative VAT amount. The outcome of Oksana’s actions and the case review was a favorable decision for the client. The lawsuit against the tax authority was fully upheld, and the tax notices-decisions to reduce the negative VAT amount totaling 860,000 UAH were annulled.
  • Support of a court case in the first-instance court for a company engaged in container manufacturing for export. Oksana proved the unlawfulness of the tax notice-decision. The court reviewed the plaintiff’s evidence and found that the inspector had unreasonably disregarded the primary documents submitted during the audit, which fully confirmed the export of goods to the counterparty. Therefore, there were no grounds for reducing the negative VAT amount. The outcome of the case review was a favorable decision for the client. The lawsuit against the tax authority was fully upheld, and the notice-decision to reduce the negative VAT amount by 420,000 UAH was annulled.
