Legal support for persons liable for military service

  1. Legal support during the application for deferral:
  • Preparation of document packages for deferral application;
  • Complete deferral service: document preparation, lawyer support during document submission, and processing of deferral until a decision is made.

  • Discharge through court by appealing the conscription decision;

  • Termination of military contracts during martial law.

05. Support for receiving payments and social benefits

  • Assistance in obtaining 15 million compensation from the state for the death of a close relative;
  • Survivor’s pension;
  • Payment of 100,000 UAH to servicemen who are undergoing inpatient treatment;
  • Assistance in obtaining compensation for funeral expenses and a monument;
  • Payments to relatives of persons who are in captivity or missing;
  • Assistance to servicemen in obtaining a salary and additional remuneration;
  • Social security in case of injury or disability.

06. Obtaining combatant status

  • Consultation on the procedure for obtaining UBD (Participant in Combat Operations status);
  • Collection and request of necessary documents for obtaining UBD;

Case No. 1 – Obtaining the status of a critically important enterprise

Situation: A company engaged in the production of PVC profiles for windows and doors requested assistance in obtaining the status of a critically important enterprise.

Our Actions: “ARMADA’s” specialists analyzed the grounds for granting the status of a critically important enterprise for the functioning of the economy and ensuring the well-being of the population during special periods. We compiled the necessary documents and prepared the justification for obtaining the status.

Result: The company received the status of a critically important enterprise and was able to reserve its employees.

Case No. 2 – Obtaining the status of a critically important enterprise for a distribution company

Situation: One of the largest distribution companies, which ranks among the top suppliers of medical products in Ukraine, including for state healthcare institutions, sought assistance from “ARMADA” to obtain grounds for reserving its employees.

Our Actions: Vadym Chornyi, an attorney at “ARMADA,” prepared a request to the Ministry of Economy of Ukraine based on the document analysis, resulting in the status of a critically important enterprise.

Result: The company received the status of a critically important enterprise and subsequently reserved its employees.

Case No. 3 – Reserving employees for a farm

Situation: A farming enterprise in Khmelnytskyi region sought our assistance in reserving its employees to continue its operations.

Our Actions: After gathering all necessary supporting documents and preparing the justification, “ARMADA’s” military law practice team obtained a decision from the Ministry of Agrarian Policy and Food of Ukraine on recognizing the enterprise as critically important for the functioning of the economy and ensuring the well-being of the population during special periods. Based on this decision, an order to reserve the enterprise’s employees was issued.

Result: The enterprise received the status of a critically important enterprise and, based on this order, reserved its employees.

Case No. 4 – Obtaining the status of a critically important enterprise for an IT company

Situation: An IT company in Kyiv sought assistance from “ARMADA” to obtain grounds for reserving its employees.

Our Actions: The military law practice team at “ARMADA” prepared a request to the Ministry of Digital Transformation of Ukraine based on document analysis, resulting in the status of a critically important enterprise.

Result: The company received the status of a critically important enterprise and subsequently reserved its employees.

Case No. 5 – Obtaining the status of a critically important enterprise and reserving employees for an industrial equipment supplier

Situation: A client involved in supplying industrial cleaning equipment and providing service and warranty support requested assistance in obtaining the status of a critically important enterprise.

Our Actions: “ARMADA’s” attorneys analyzed the grounds for granting the status of a critically important enterprise, compiled the necessary documents, and prepared the justification for obtaining the status.

Result: The client received the status of a critically important enterprise and reserved its employees.

Case No. 6

Situation: The client requested assistance in obtaining the status of a critically important enterprise for the functioning of the Ukrainian economy to reserve employees.

Our Actions: According to the new Order on reserving, enterprises not performing mobilization tasks and not meeting the needs of the Armed Forces of Ukraine may obtain the status of a critically important enterprise if they meet three criteria defined by the Order. After gathering all necessary documents and preparing the justification, “ARMADA’s” attorneys obtained a decision from the Ministry of Economy of Ukraine recognizing the enterprise as critically important for the economy and population well-being during special periods.

Result: The client received a decision from the Ministry of Economy of Ukraine recognizing the enterprise as critically important, allowing for the reservation of employees.

Case No. 7

Situation: The client requested assistance in obtaining a decision to extend the reservation of employees. The enterprise had received a six-month deferment from military service based on the Ministry of Economy’s Order dated April 4, 2022. With the expiration of the deferment, there was a need for an extension.

Our Actions: “ARMADA’s” attorneys analyzed the documents and prepared the necessary justification for extending the deferment due to the enterprise’s critical role under martial law.

Result: The client received an extension of the deferment from conscription for its employees during mobilization.

Case No. 8

Situation: Two food industry enterprises with mobilization tasks requested “ARMADA’s” help to obtain employee reservations.

Our Actions: The company’s attorneys analyzed the documents and prepared a request with justification to the district state administration for reserving the employees.

Result: An order from the Ministry of Economy of Ukraine was obtained, reserving the employees of the enterprises.
