Alexander’s Recent Experience Includes:
- Arbitration dispute at FOSFA regarding contract default. As part of the practice team, represented a Ukrainian client company in a dispute with a Turkish buyer under a FOSFA contract. The buyer declared the contract in default due to a three-day delay in delivery by our client. Alexander and the project team proved that the delivery deadlines had been previously agreed upon by the parties without formal written amendments, and therefore, the contract default was declared in violation of the supplier’s rights. Claim amount: USD 2,726,000.
- Arbitration dispute at GAFTA regarding compensation of damages (the difference between contract and market prices). Claim amount: USD 1,405,000.
- Dispute between a Ukrainian importer of industrial equipment NDA and a German manufacturer of automated production lines. Claim amount: USD 2,500,000.
- Client and foreign investment protection. Support for a Ukrainian company entering export markets. A group of companies requested consultation and assistance in submitting notifications on controlled foreign companies and tax structuring of export activities of affiliated legal entities. Case amount: USD 50,000,000.
- Protection of foreign investments. Consultation and registration of a representative office in Ukraine for one of the largest manufacturers of optical devices and thermal scopes, and tax structuring of business operations. Investment amount: USD 1,500,000.
- UDP (Ukrainian Development Partners), LLC “LVIV STANDARTBUD” vs. RF. Support in documenting war damages. Representation of the owner of LvivTech.City office center after it was damaged by a blast wave from Russian missile strikes on Lviv. Damage amount: over USD 2,000,000.
- LLC “OMEGA-AUTOPOSTAVKA TRADING AND INDUSTRIAL COMPANY” vs. RF. Representation in the ECHR and Ukrainian courts. Representation of a group of companies in the ECHR in cases against the RF for violations of property rights, representation in Ukrainian courts, and investment arbitration. Damage amount: over USD 9,000,000.
- Support in documenting war damages for LLC “OLWOOD”. Comprehensive support for recording and claiming war damages for a large wood processing enterprise. Damage amount: over USD 13,770,000.
- Representation of PJSC “MHP” in the ECHR and Ukrainian courts. Representation of a group of companies in the ECHR in disputes against the RF for violations of property rights, and in Ukrainian courts. Damage amount: over USD 50,000,000.
